Terms of Service

1. Eligibility

You must have reached the legal age of majority in your place of residence and have legal capacity to enter into a binding agreement.

If you act for a company, studio, client, or other organization, you represent that you are authorized to act on its behalf.

2. Website Use

You may use the website only for lawful purposes.

You may not:

• Interfere with website operation or security
• Attempt unauthorized access
• Introduce malicious code
• Use automated methods to scrape or misuse content
• Submit false or misleading information
• Commit fraud
• Infringe intellectual-property rights
• Use the website in violation of applicable law

3. Products and Made-to-Order Status

Ready Styles are pre-designed pillow cover styles generally made after an order is placed using currently available materials.

Custom Projects are made according to customer-approved specifications.

Product photographs, Lookbook images, color references, and styled-room images are intended to communicate appearance and design direction. Exact color, texture, pattern placement, size, and material characteristics may vary as described in our policies.

4. Product Availability

All products, materials, colors, trims, sizes, and services are subject to availability.

DomiCraft may:

• Limit quantities
• Refuse a project
• Discontinue a style
• Substitute an approved comparable material
• Revise pricing
• Cancel an unavailable item and issue the applicable refund

No product or project is guaranteed until accepted and confirmed by DomiCraft.

5. Pricing and Currency

Unless otherwise stated, website prices are shown in U.S. dollars.

Prices may change without notice before an order is accepted.

Applicable sales tax will be calculated and collected where required by law.

Custom Project pricing will be stated in the applicable quote, invoice, or production confirmation.

6. Errors and Corrections

DomiCraft may correct errors involving:

• Product descriptions
• Prices
• Discounts
• Availability
• Shipping charges
• Tax calculations
• Images
• Website content
• Technical or typographical mistakes

If an order is affected by a material error, DomiCraft may contact the customer to request confirmation of the corrected terms or cancel and refund the affected order.

7. Order Acceptance

Submitting an order does not guarantee acceptance.

DomiCraft may reject, hold, or cancel an order for reasons including:

• Pricing or website error
• Material unavailability
• Payment failure
• Inability to verify payment
• Suspected fraud
• Shipping restrictions
• Incomplete information
• Inability to meet requested project requirements
• Violation of these Terms

If DomiCraft cancels a paid order before production because it cannot be fulfilled, the applicable amount will be refunded.

8. Payment

Website payments are expected to be processed through Stripe or another authorized payment provider.

By submitting payment information, you represent that:

• You are authorized to use the payment method
• The information is accurate
• Charges may be processed for the order or approved project
• The payment provider may perform fraud and identity checks

Custom Projects may require a deposit, staged payment, or full payment before production.

9. Order Changes and Cancellation

Customers may request changes or cancellation on the same calendar day an order is placed, provided production has not begun.

Once production has begun, an order cannot be changed or cancelled.

Custom Projects become non-cancellable after the customer has approved the relevant specifications and paid the required deposit or payment.

10. Custom Project Documents

For a Custom Project, the following may form part of the agreement:

• Quote
• Invoice
• Project brief
• Email confirmation
• Specification sheet
• Production confirmation
• Shipping quote
• Approved artwork or measurements

11. Shipping and Delivery

Shipping is governed by the DomiCraft Shipping Policy.

Delivery dates are estimates unless expressly guaranteed in writing.

If DomiCraft cannot ship within the confirmed timeframe, it may provide a revised estimate and, where required, allow the customer to accept the delay or cancel the unshipped order for the applicable refund.

Customers are responsible for accurate delivery information and any additional costs caused by an incorrect address, refused delivery, or failure to collect a package.

12. Returns and Refunds

Returns, cancellations, exchanges, defects, and refunds are governed by the DomiCraft Return & Refund Policy and Custom Order Policy.

Because products are generally made after an order is placed, items are final sale once production begins, except where damaged, defective, incorrect, materially different from the confirmed order, or otherwise required by law.

13. Trade Program

DomiCraft Trade is available only to approved applicants.

DomiCraft may:

• Request business verification
• Approve or reject an application
• Suspend or cancel Trade status
• Change Trade benefits
• Change project-pricing terms
• Exclude products or services from Trade pricing
• Require updated business information

Trade approval does not guarantee any particular discount, credit arrangement, sample program, product availability, exclusivity, or project acceptance.

Applicants must provide accurate business information.

14. Customer Content

If you submit photos, drawings, logos, artwork, room plans, measurements, moodboards, labels, or other materials, you represent that:

• You have the right to provide them
• Their use does not violate third-party rights
• DomiCraft may use them as necessary to quote, plan, produce, and fulfill your project

You remain responsible for the legality and accuracy of customer-supplied content.

DomiCraft will not publicly use customer project materials for marketing or portfolio purposes without permission.

15. DomiCraft Intellectual Property

The website and its content, including:

• DomiCraft name and branding
• Lookbook content
• Website design
• Text
• Graphics
• Product photography
• Style references
• Layouts
• Original designs
• Videos and other media

are owned by or licensed to DomiCraft and are protected by applicable intellectual-property laws.

You may not reproduce, modify, distribute, sell, publish, or commercially exploit this content without written authorization.

16. Third-Party Services

The website may use or link to third-party services, including:

• Stripe
• WooCommerce
• Hostinger
• Shipping carriers
• YouTube
• Social-media platforms

Third-party services are governed by their own terms and privacy policies.

DomiCraft is not responsible for third-party websites, systems, delays, outages, policies, or content outside its reasonable control.

17. Disclaimer of Warranties

To the fullest extent permitted by law, the website and its content are provided on an “as available” basis.

DomiCraft does not guarantee that:

• The website will always be uninterrupted or error-free
• Every material or product will remain available
• Digital color will exactly match physical materials
• Delivery estimates will never be affected by external conditions
• Website content will be free of every technical or typographical error

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

18. Limitation of Liability

To the fullest extent permitted by law, DomiCraft and Nova Merchants Tech INC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive losses arising from:

• Website use
• Business interruption
• Lost profits
• Project delays
• Third-party carrier actions
• Customer measurement errors
• Customer-supplied content
• Unauthorized access outside our reasonable control

Where liability cannot be excluded, DomiCraft’s aggregate liability relating to a specific order will generally not exceed the amount paid to DomiCraft for the product or service giving rise to the claim, except where applicable law requires otherwise.

19. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless DomiCraft and Nova Merchants Tech INC from claims, losses, or expenses arising from:

• Your violation of these Terms
• Your unlawful website use
• False information supplied by you
• Customer content that infringes third-party rights
• Your misuse or resale of products
• Your failure to obtain necessary permissions

20. Informal Dispute Resolution

Before initiating a formal legal claim, you agree to contact DomiCraft at hello@domicraftshop.com and make a good-faith effort to resolve the issue informally.

Please include sufficient information to identify the order, project, and nature of the dispute.

21. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict-of-law principles.

Any dispute that cannot be resolved informally will be brought before a court of competent jurisdiction in Colorado, unless applicable consumer law requires a different venue or governing rule.

22. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

23. Waiver

Failure by DomiCraft to enforce a provision does not waive the right to enforce it later.

24. Changes to These Terms

DomiCraft may update these Terms to reflect changes in law, operations, services, or website functionality.

The updated Terms will be posted on this page with a revised date.

Terms applicable to an accepted order or confirmed project generally remain those in effect when the order or project was accepted, unless the parties agree otherwise or applicable law requires a change.
